RE: Filing Fee For Petitions for 90-Day Extension In Actions For Personal Injury Or Wrongful Death Arising Out Of Medical Negligence
REF: CV-2006-005-SC (Rescinds CV-2000-005-SC)

WHEREAS, Section 766.104(2), Florida Statutes, provides that a filing fee be paid to the Clerk of the Circuit Court for petitions for an automatic 90-day extension of the statute of limitations to allow reasonable investigation in actions for personal injury or wrongful death arising out of medical negligence,

NOW THEREFORE, I, WILLIAM A. PARSONS, Chief Judge of the Seventh Judicial Circuit, hereby establish a $37.50 filing fee in such actions, payable to the Clerk of the Circuit Court in the county in which the underlying cause of action is to be filed. This shall not be deemed to revive a cause of action on which the statute of limitations has run.

IT IS FURTHER ORDERED that Administrative Order CV-2000-005-SC is hereby rescinded.

TO BE RECORDED in Flagler, Putnam, St. Johns and Volusia Counties.
