IN THE CIRCUIT COURT OF FLORIDA, SEVENTH JUDICIAL CIRCUIT
IN AND FOR FLAGLER, PUTNAM, ST. JOHNS AND VOLUSIA COUNTIES


RE: CASE STATUS REPORTING REQUIREMENTS
FOR REAL PROPERTY MORTGAGE FORECLOSURE CASES      
REF: CV-2013-014-SC

WHEREAS, the Florida Supreme Court has adopted definitions related to the status of a foreclosure case that are published in the Foreclosure Initiative Data Collection Plan promulgated by the Office of the State Courts Administrator, and

WHEREAS, the Florida Supreme Court requires the chief judge of every circuit to issue an administrative order implementing an effective communication mechanism by which the courts and clerks are notified of case status changes in a timely manner.  Furthermore, each chief judge is required to issue an administrative order providing explicit direction for designating the status of cases as active or inactive.  (See AOSC13-51 In Re: Case Status Reporting Requirements for Real Property Mortgage Foreclosure Cases);

NOW THEREFORE, I TERENCE R. PERKINS, Chief Judge of the Seventh Judicial Circuit, hereby order as follows:

1. The Clerks of Court of the counties of Flagler, Putnam, St. Johns & Volusia (Clerks) shall comply with the requirements of the Foreclosure Initiative Data Collection Plan promulgated by the Office of the State Courts Administrator.

2. The Clerks shall notify presiding judges if they become aware of events that may initiate a change in the status of a case (active or inactive) and await further direction.

3. Upon being made aware of events that may initiate a change in the status of a case, the presiding judge should review the matter and if appropriate, issue an order changing the status of the case (see attached form orders).    

4. Nothing in this order prohibits judges from entering orders changing the status of cases on their own accord, without being made aware of a qualifying event by a clerk.
