RE: Florida Fish and Wildlife Conservation Commission
Recreational Harvester Bond Schedule for St. Johns County, Florida
REF: CR-2017-003-SJ

WHEREAS, §379.1025, Florida Statutes, grants the Florida Fish and Wildlife Conservation Commission the authority to make such rules and regulations as are necessary for the management and protection of fisheries within the State of Florida, including the fisheries in St. Johns County, and provides that violation of said rules and regulations is a misdemeanor per §§ 379.401 and 379.407, and

WHEREAS, a bond schedule is needed for violations of said rules and regulations within the boundaries of St Johns County in order to eliminate mandatory court appearances and in order to permit pleas of guilty by bond estreature, and

WHEREAS, the rules and regulations pertaining to certain species of finfish, crustaceans, and shellfish were amended effective July 1, 2012;

NOW THEREFORE, I, TERENCE R. PERKINS, Chief Judge of the Seventh Judicial Circuit of Florida, hereby order that the following bond schedule shall be applicable to the listed violators of Chapter 379 Florida Statutes, and the rules and regulations promulgated by the Florida Fish and Wildlife Conservation Commission.  At the arresting law enforcement officer’s discretion, this bond schedule may apply to all violations of recreational harvester bag limits and size limits, and anyone so charged may post the listed bond amount in lieu of appearance in court.  The penalties or bonds assessed pursuant to this order shall be deposited into the Marine Resources Conservation Trust Fund pursuant to § 379.208(2), Florida Statutes.                                                                  

BASE BONDS:

Possession of 1 to 2 undersized or oversized finfish or crustaceans: $125
Possession of 3 or more undersized or oversized finfish or crustaceans: $250

Possession of 1 to 2 finfish or crustaceans (except shrimp) in excess of the daily bag limit:  $125
Possession of 3 or more finfish or crustaceans (except shrimp) in excess of the daily bag limit: $250

Hard Clams or oysters: Possession of 1 to 25 undersized clams or oysters: $125.  More than 25 undersized hard clams or oysters: $250

Possession of hard clams or oysters in excess of the daily bag limit: $125; and an additional $10 shall be imposed per gallon bucket of product or any portion which may be more or less than a 1-gallon bucket, i.e. ½ or ¼ gallon

Shrimp: Possession of shrimp in excess of the daily bag limit: $125; and an additional $10 shall be imposed per gallon bucket of product or any portion which may be more or less than a 1-gallon bucket, i.e. ½ or ¼ gallon

Other Violations and associated bonds:

Harvest by illegal method - $125; and an additional $10 shall be imposed per every finfish or crustacean (except shrimp) in excess of the first finfish or crustacean (except shrimp) harvested by illegal method.

Use of Cast Net within 50 yards north of Guana Dam Structure - $125

Unattended Hook & Line Gear - $125

Fishing more than 3 poles, Guana WMA - $125

Harvest during a Closed Season - $125

Fish Not Landed in Whole Condition - $125

Possession of Egg Bearing Crawfish/Crab - $250

Possession of wrung crawfish tails on the water - $250

IT IS FURTHER ORDERED that fines and costs in the amounts referenced above are to be imposed by the Court for violations of §§ 379.401 and 379.407, Florida Statutes.
