IN THE CIRCUIT COURT OF FLORIDA, SEVENTH JUDICIAL CIRCUIT
IN AND FOR FLAGLER, PUTNAM, ST. JOHNS AND VOLUSIA COUNTIES


RE: Dismissal of Misdemeanor Cases
REF: CR-2017-020-SC

WHEREAS, misdemeanor criminal division dockets throughout the circuit are comprised of numerous cases that are older than 6 years, and

WHEREAS, it has been made known to the undersigned that the prompt and efficient administration of justice in the Seventh Judicial Circuit would be best served by the establishment of a policy setting dismissal dates for misdemeanor cases that remain on dockets for more than 6 years, and  

WHEREAS, a separate administrative order creates by default a 2-year expiration date for warrants in misdemeanor cases;

NOW THEREFORE, I, TERENCE R. PERKINS, Chief Judge of the Seventh Judicial Circuit of Florida, hereby order that all pending misdemeanor cases in Flagler, Putnam, St. Johns and Volusia counties shall automatically be dismissed 6 years from the date of the last Court action, absent a specific directive to the contrary in individual cases by the presiding judge.  This dismissal includes pending violations of probation, cases where warrants have expired, and cases where no warrants were issued, but D-6 suspensions were issued.  Any pending violations of probation are to be terminated unsuccessfully.  Any pending D-6 suspensions are to be released without costs.  Any unpaid monetary obligations owed by defendants in affected cases are to be referred to collection agencies and/or converted to civil judgments.
