RE: Determination of Indigence in Felony, Misdemeanor and Juvenile Delinquency Cases
REF: CR-2017-042-SC

WHEREAS, the Florida Legislature has placed the responsibility for determining indigence in felony, misdemeanor and juvenile delinquency cases with the Clerks of Court;

NOW THEREFORE, I, TERENCE R. PERKINS, Chief Judge of the Seventh Judicial Circuit of Florida, hereby order that indigence determinations in felony, misdemeanor and juvenile delinquency cases shall be made by the Clerks of Court in accordance with § 27.52, Florida Statutes.

IT IS FURTHER ORDERED that pursuant to § 27.52(1), F.S., judges may make preliminary indigence determinations pending further review by Clerks of Court and may appoint counsel on an interim basis.  Interim judicial appointments of the Public Defender issued at First Appearance hearings, Juvenile Detention hearings, or any other court proceeding, remain in effect until the Public Defender is relieved. The filing of a Notice of Appearance by a private attorney in a case in which the Public Defender was previously appointed is sufficient evidence of said relief.
