IN THE CIRCUIT COURT OF FLORIDA, SEVENTH JUDICIAL CIRCUIT
IN AND FOR FLAGLER, PUTNAM, ST. JOHNS AND VOLUSIA COUNTIES


RE: CHILD SUPPORT AND PURGE PAYMENTS
REF: FM- 2002-025-SC

WHEREAS, it has been made know to the undersigned that checks received by the Clerk of Circuit Court for payment of child support and/or purges are occasionally returned and deemed worthless;

NOW THEREFORE, I ROBERT K. ROUSE, JR., Chief Judge of the Seventh Judicial Circuit of Florida, hereby order as follows:

1.      Clerks of Court in the Seventh Judicial Circuit are authorized to refuse personal checks for ongoing child support payments, and for purge payments tendered by a party other than the payor, unless the payor’s name is reflected on the face of the check.  This shall not be construed to prevent acceptance of checks tendered by a business as the result of an Income Deduction Order.

2.     Pursuant to § 61.18 (5), Florida Statutes, the Clerks of Court in the Seventh Judicial Circuit are authorized to refuse any payment except cash, cashier’s check, or money order, from a payor if any previously accepted check has been deemed worthless.

3.     Clerks of Court in the Seventh Judicial Circuit are authorized to retain any subsequent payment(s) received from a payor to recover monies disbursed to the corresponding payee prior to notification from a banking institution that a check received was worthless.
