IN THE CIRCUIT COURT OF FLORIDA, SEVENTH JUDICIAL CIRCUIT
IN AND FOR FLAGLER, PUTNAM, ST. JOHNS AND VOLUSIA COUNTIES


RE: ELECTRONIC RECORDING OF DOMESTIC VIOLENCE INJUNCTION HEARINGS
REF: FM-2002-033-SC

WHEREAS, pursuant to sec. 741.30(6)(h), Florida Statutes, domestic violence injunction hearings must be recorded, and

WHEREAS, the Seventh Judicial Circuit has elected to make a record in these proceedings by electronic means, as provided by Rule 2.070(g)(3), Florida Rules of Judicial Administration;

NOW THEREFORE, I, ROBERT K. ROUSE, JR., Chief Judge of the Seventh Judicial Circuit of Florida, hereby order as follows:

1.       Electronic recording equipment shall be used for the purpose of recording such domestic violence injunction hearings that are required to be recorded.

2.       The electronic recording equipment shall be operated by Deputy Clerks of Court, or other qualified personnel, in such a manner as to ensure the production of an accurate, understandable record.

3.       The Deputy Clerks of Court, or other qualified personnel, shall maintain logs of all proceedings recorded during each court session.  The logs and the corresponding recordings shall be properly identified and safely stored in locations designated by the respective Clerks of Court.  Destruction of these records shall be in accordance with Rule 2.075(f), Florida Rules of Judicial Administration.

4.       Parties may obtain copies of recordings for a fee set by the Chief Judge. 

5.       In the event a party would like to obtain a transcript of a proceeding, he/she must purchase a copy of the recording and make independent arrangements for its transcription with a certified court reporter or transcriber.

6.       In the event the Court requires a transcript of a proceeding, the Clerk of Court shall make a copy of the recording and forward it to the Official Court Reporter in the appropriate county for transcription.
