IN AND FOR VOLUSIA COUNTY
RE: PROBATE FILES
WHEREAS, the Supreme Court of Florida has adopted Rule 2.085, Florida Rules of Judicial Administration, setting case time standards and requiring the trial courts to take charge of all cases in order to monitor and control the pace of litigation, and
WHEREAS, it appears from the court records that there are estate files in Volusia County which have not been concluded within the time standards as set forth in Rule 2.085, Florida Rules of Judicial Administration and
WHEREAS, the duties and responsibilities of the Clerk of the Circuit Court are not clearly defined with regard to monitoring these files and keeping judges informed as to which cases exceed the time standards,
NOW, THEREFORE, I, ROBERT K. ROUSE, JR, Chief Judge of the Seventh Judicial Circuit, hereby direct the clerk as follows:
1. The Office of the Clerk of the Circuit Court of Volusia County, shall review all estate files to determine if these cases have been concluded within the case time standards. In performing the review, if the clerk finds that a case has not been concluded within the time standards, the attached “ORDER TO FILE DOCUMENTS”* shall be submitted to the assigned judge for his/her consideration.
2. If the personal representative or attorney fail to comply with the ORDER TO FILE DOCUMENTS*, the clerk shall forward the attached “ORDER TO SHOW CAUSE”* to the assigned judge for his/her consideration.
3. Nothing in this order requires any judge to use the forms submitted by the clerk or prevents any judge from entering such other orders as may be appropriate.
