IN THE CIRCUIT COURT OF FLORIDA, SEVENTH JUDICIAL CIRCUIT
IN AND FOR FLAGLER, PUTNAM, ST. JOHNS AND VOLUSIA COUNTIES


RE: PROFESSIONAL GUARDIANSHIP EDUCATION

Rescinds PB-2011-07-SC

WHEREAS,“Professional Guardian” is defined in § 744.102(17), Florida Statutes, and

WHEREAS, § 744.2003(3), Florida Statutes, requires professional guardians to receive a minimum of 40 hours of initial instruction and training and a minimum of 16 hours of continuing education every 2 years thereafter, and

WHEREAS, the aforementioned education and training must be completed through courses approved or offered by the Office of Public and Professional Guardians,

WHEREAS, § 744.2003(6), Florida Statutes, requires professional guardians to demonstrate their competency by taking and passing an examination approved by the Department of Elderly Affairs, and

WHEREAS, § 744.2003(8), Florida Statutes, requires that the Department of Elderly Affairs waive the aforementioned examination requirement provided certain criteria are met;

NOW THEREFORE, I, TERENCE R. PERKINS, Chief Judge of the Seventh Judicial Circuit of Florida, hereby order that pursuant to § 744.2003(9), Florida Statutes, judges may not appoint individuals to serve as professional guardians who have not met the requirements of this Order and §§ 744.2002 & 744.2003, Florida Statutes.
